Terms of Service

1. Acceptance of Terms

By accessing or using TheGimme ("the Service", "we", "us", "our"), you agree to be bound by these Terms of Service. The Service is owned and operated by Broschb Labs LLC. If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

TheGimme is a golf score tracking, handicap calculation, and social networking platform. The Service allows users to track rounds, calculate handicaps, connect with other golfers, and access golf course information.

3. User Accounts

When you create an account, you must provide accurate, complete, and current information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. User Conduct & Zero-Tolerance Policy

TheGimme is committed to providing a safe, respectful, and inclusive environment for all users. We have a zero-tolerance policy for the following behaviors:

  • Harassment, hazing, bullying, intimidation, or threats of any kind directed at other users, whether through scores, comments, messages, profiles, or any other feature of the Service.
  • Hate speech, discriminatory language, or content that promotes violence, racism, sexism, or any form of discrimination.
  • Posting or sharing offensive, obscene, or inappropriate content, including but not limited to profile pictures, nicknames, score comments, or direct messages.
  • Impersonating other individuals or entities.
  • Any form of hazing, initiation rituals, or demeaning activities targeting other users.
  • Using social features to stalk, harass, or intimidate others.

Violation of this policy may result in immediate suspension or permanent termination of your account without notice, at our sole discretion. We encourage users to report any violations to support@thegimme.app.

5. User-Generated Content

The Service allows you to post, link, store, share, and otherwise make available certain information, text, graphics, scores, or other material ("Content"). You retain all rights to your Content but grant us a non-exclusive, worldwide, royalty-free license to use, store, and display your Content solely for the purpose of operating and improving the Service.

You represent and warrant that: (i) your Content does not violate these Terms; (ii) you own or have the necessary rights to your Content; and (iii) your Content will not cause injury to any person or entity.

We reserve the right, but have no obligation, to monitor, edit, or remove Content that we determine in our sole discretion violates these Terms or is otherwise objectionable.

Course contributions. If you submit course information — including scorecards, photographs of scorecards, hole numbering, or map geometry — you grant Broschb Labs LLC a perpetual, worldwide, royalty-free license to use, modify, and publish that submission as part of the Service. Course submissions are reviewed before they affect course data. You acknowledge that approved course map geometry is published under the Open Database License as described in section 9, and you confirm that you have the right to submit the information.

6. Social Features

The Service includes social features such as friend requests, leaderboards, and social feeds. You acknowledge that:

  • You can control your profile visibility through privacy settings.
  • Scores and handicap data you share may be visible to your friends or the public depending on your settings.
  • You can report other users who engage in inappropriate behavior by emailing support@thegimme.app. We review every report and may suspend or terminate the accounts involved.
  • We are not responsible for the conduct of any user, whether online or offline.

Social features are provided for legitimate golf-related networking and competition. Any use of social features for harassment, solicitation, or any purpose other than golf-related interaction is strictly prohibited.

7. Handicap Calculation

TheGimme provides handicap calculation services based on the scores you enter. While we strive for accuracy, handicap indices are provided for informational and recreational purposes only. They should not be relied upon for official competition purposes unless accepted by the applicable golf association. We make no warranties regarding the accuracy of handicap calculations.

8. Subscription & Billing

TheGimme offers free and paid subscription tiers ("Pro"). Paid subscriptions are billed monthly or annually as selected at the time of purchase. All payments are processed securely through Stripe. Subscription fees are non-refundable except as required by applicable law. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in downgrade to the free tier.

9. Copyright & Intellectual Property

The Service, including its design, graphics, logos, and software, is owned by Broschb Labs LLC and is protected by copyright, trademark, and other intellectual property laws. Except for the course map data described below, you may not reproduce, distribute, modify, or create derivative works without our express written consent.

Course map data. Golf course map geometry in the Service — greens, fairways, bunkers, hazards, tee boxes, and hole centerlines — is derived from OpenStreetMap and is made available under the Open Database License (ODbL) 1.0. Map data © OpenStreetMap contributors.

As required by section 4.6 of the ODbL, we will provide any recipient of this data with a machine-readable copy of our derived course geometry database, or of our alterations to the OpenStreetMap database, free of charge. To request a copy, email support@thegimme.app. This offer is valid for three years from the date of these Terms.

This licensing applies only to course map geometry. It does not apply to your rounds, scores, shot data, handicap, statistics, or any other information about you or your play, none of which is published under the ODbL.

10. Third-Party Services

The Service integrates with third-party services including Stripe (payment processing), OpenStreetMap and Esri ArcGIS (course mapping and map imagery on the web), your device's built-in map provider (Apple Maps or Google Maps) in the mobile app, and OAuth providers (Google, Facebook, Twitter for authentication). Your use of these services is subject to their respective terms and policies. We are not responsible for the practices of third-party services.

11. Limitation of Liability

To the maximum extent permitted by law, Broschb Labs LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from your use of the Service.

12. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. Golf course data, including distances and course ratings, is provided for reference and may not be 100% accurate.

13. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. We may retain your data as required by law or for legitimate business purposes. You may delete your account at any time through the settings page.

14. Data Retention & Deletion

Upon account deletion, we will delete your personal data and round data within 30 days, except as required to comply with legal obligations, resolve disputes, or enforce our agreements. Archived data may retain anonymized or aggregated information for analytics purposes.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Delaware.
